Terms & Conditions

These terms govern all web design and related services provided by KM Web Design. By commissioning work from me, you agree to these terms.

If anything is unclear, please ask before work begins — I am always happy to explain.

1. The parties

"I", "me", "my" refers to KM Web Design, based in Norfolk, United Kingdom.

"You", "the client" refers to the individual or business commissioning the work.

2. Quotes and project scope

All quotes are valid for 30 days from the date issued. A quote covers only the work explicitly described within it. Any additional pages, features or functionality requested after a quote is agreed will be subject to a separate quote or charged at my hourly rate of £40.

Work begins only once a quote has been accepted in writing (email is sufficient) and the deposit has been received.

3. Payment

Deposit

A non-refundable deposit of 50% of the agreed build fee is due before any work begins. This secures your place in my schedule.

Final payment

The remaining 50% is due before the website goes live. The site will not be launched until the final payment has cleared.

Invoices

Invoices are payable within 14 days. Late payment may result in work being paused. If an invoice remains unpaid after 30 days, I reserve the right to charge interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.

Ad hoc work

Work outside the scope of the original project or the care plan is charged at £40 per hour, invoiced on completion.

4. Revisions

Revisions are included throughout the build process — I want you to be happy with the result. However, revisions mean amendments to the agreed design and scope. A significant change in direction, a change to the brief, or requests that fall outside the original scope are treated as new work and quoted separately.

Where revision requests require substantial additional time, I will let you know in advance and these will be charged at £40 per hour.

5. Your responsibilities

To keep the project on track, you agree to:

  • Provide all content (text, images, logos) in a timely manner and in a usable format
  • Respond to questions and requests for feedback within a reasonable timeframe (typically 5 working days)
  • Ensure all content you provide is either owned by you or that you have the right to use it
  • Review and approve work at each stage before the project progresses

If the project is delayed due to outstanding content or feedback from your side for more than 4 weeks, I reserve the right to reschedule the project or charge a restart fee.

6. Timeline

Estimated timelines are provided in good faith but are not guaranteed. Timelines depend on both parties being responsive and on content being supplied on time. I will always keep you informed if there is likely to be a delay on my side.

7. Intellectual property

Your content

You confirm that all text, images, logos and other materials you provide are either owned by you or that you have permission to use them. You indemnify me against any claims arising from content you have supplied.

The finished website

Ownership of the completed website and its design transfers to you in full once all outstanding payments have been made. Until then, all work remains my intellectual property.

Portfolio use

Unless you request otherwise in writing, I reserve the right to display the completed website in my portfolio and use it in marketing materials.

8. Ongoing support

Because your website is custom coded, all updates and changes must be made by me. After launch, ongoing support is available in two ways:

Annual care plan

The recommended option for most clients. Charged at £20/month for all packages, billed annually by invoice, the care plan covers:

  • Ongoing hosting management
  • Reasonable content updates (text changes, image swaps)
  • Email support
  • Annual SEO health check

The care plan is billed annually and can be cancelled with 30 days' written notice before the next renewal date. Cancellation does not affect your ownership of the site — you will receive all files and can make alternative hosting arrangements.

Pay as you go

If you prefer not to commit to a monthly plan, changes and updates can be made on an hourly basis at £40/hour, invoiced on completion.

Neither option covers new pages, new sections, redesigns, or additional integrations — these are quoted separately.

9. Cancellation

Cancellation by the client

If you cancel after work has begun, the deposit is non-refundable. If work has progressed beyond the point covered by the deposit, a cancellation fee may be charged proportionate to the work completed.

Cancellation by me

I reserve the right to decline or cease work if requested content or behaviour is unlawful, offensive or in breach of these terms. In such cases, any deposit paid will be refunded proportionate to work not yet completed.

10. Limitation of liability

I will always do my best work, but I cannot guarantee specific business outcomes (such as search rankings or increased sales) from a website.

My total liability for any claim arising from services provided shall not exceed the total amount paid by you for the project in question.

I am not liable for any loss caused by third-party services (such as hosting providers, form processors or analytics tools), nor for any downtime or data loss beyond my reasonable control.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

I may update these terms from time to time. The current version always applies to new projects. The date at the top of this page shows when they were last updated.
